TERMS AND CONDITIONS OF HOTMART FIRE 2025
The digital entrepreneurship event currently called "Hotmart Fire 2025" ("Event") is the exclusive property of the company LAUNCH PAD TECNOLOGIA, SERVIÇOS E PAGAMENTOS LTDA., registered with the CNPJ/ME under nº 13.427.325/0001-05, headquartered in the city of Belo Horizonte, state of Minas Gerais, at Avenida Assis Chateaubriand, nº 499, Bairro Floresta, CEP nº 30.150-101 ("Hotmart"). Hotmart owns all rights and authorizations necessary for the realization of the Event. Therefore, by purchasing a ticket to participate in the Event ("Participant"), the Participant agrees, fully, unreservedly, and irrevocably, to these Terms and Conditions of the Event ("Terms"), governed by the following conditions:
FIRST CLAUSE - DESCRIPTION OF THE EVENT AND ACCESS METHODS:
1.1. The Event consists of a digital entrepreneurship event, composed of lectures, classes, workshops, and in-person and/or online meetings, with the objective of promoting knowledge and the exchange of information in the aforementioned sector, as well as encouraging the production of digital products in their various formats.
1.1.1. The current edition of the Event will be held only in person, with the possibility, at Hotmart's sole discretion, of offering additional content, delivered in person and/or online.
SECOND CLAUSE - DATE AND LOCATION OF THE EVENT:
2.1. The Event will take place from August 28 to 30, 2025, and will occur at the event venue called "Expominas," located at Av. Amazonas, nº. 6.200, Bairro da Gameleira, CEP nº 30510-000, in the city of Belo Horizonte, Minas Gerais. Both the location and the date of the Event are subject to change.
THIRD CLAUSE - TARGET AUDIENCE OF THE EVENT:
3.1. This Event is intended for anyone interested in learning more about the world of digital entrepreneurship through lectures, classes, workshops, and in-person meetings with important figures in digital marketing, as well as inspirational names and influencers, with the aim of helping and encouraging producers in the creation, development, production, promotion, and sale of digital products.
3.2. The age rating of the Event is, for the most part, unrestricted. The participation of individuals over 16 and under 18 years old without accompaniment will be permitted, provided they present a signed liability waiver, which will be available at this link and at the entrance of the Event. In turn, the participation of individuals under 16 (sixteen) years old will only be permitted if they are properly accompanied by parents or legal guardians and also present the aforementioned signed liability waiver.
3.3. The parents or legal guardians of underage Participants acknowledge and agree that, during the Event, alcoholic beverages may be available, free of charge or not, in designated areas and/or during parts of the Event, and that they will not have access to such spaces/parts of the Event, even if accompanied. It is expressly prohibited to provide alcoholic beverages to minors.
FOURTH CLAUSE - EVENT SCHEDULE:
4.1. The Event schedule, including the order of days and times of lectures and respective speakers, is subject to change for various reasons beyond Hotmart's control. However, Hotmart commits to keeping the schedule and Event information duly updated on its official page. Therefore, the Participant will be solely responsible for keeping up with any updates to the schedule and other information about the Event, releasing Hotmart from any responsibility for possible changes to the Event schedule.
4.1.1. Participants who purchase tickets for the Event during the promotional lot, sold during the period of the Fire Festival 2024 (August 29 to 31, 2024), or even before the definition and disclosure of the Event's speakers and activities, declare that they are aware and agree that they cannot request a refund and/or any type of compensation for not agreeing with the future lineup of lectures, classes, workshops, and/or any Event activities, given that the purchase was made without such information.
FIFTH CLAUSE - TICKETS AND PAYMENT METHODS:
5.1. The initial sales of Event tickets, in the promotional lot, will take place between August 29 and September 31, 2024. Additional lots, after the conclusion of this lot, will be available on the Event's website, located at fire.hotmart.com, as well as on Hotmart's and/or the Event's social media.
5.2. Four (4) types of tickets will be offered for the Event, as described below:
(i) BIZ: grants access to the basic package of the in-person Event, which will consist of lectures, classes, and workshops to be announced. Other content and/or activities may be offered, at Hotmart's sole discretion.
(ii) BIZ DAY: grants access to the basic package of the in-person Event, which will consist of lectures, classes, and workshops to be announced by Hotmart until the Event date, for a period of 1 (one) day, which will be defined at the time of purchase. Other content and/or activities may be offered, in person and/or online, at Hotmart's sole discretion.
(iii) VIP: grants access to the basic package of the in-person Event, which will consist of lectures, classes, and workshops to be announced, as well as access to the VIP area that will exist at the Event location and its benefits, to be announced by Hotmart until the Event date. Other content and/or activities may be offered, in person and/or online, at Hotmart's sole discretion.
5.3. The ticket prices corresponding to each of the Event's ticket types, in each of the offered lots, will be disclosed at the ticket sales locations, namely: (i) the Event's website and (ii) Hotmart's website, as well as on Hotmart's and/or the Event's social media. The Participant also declares and agrees that the aforementioned prices may change with each lot that is made available.
5.3.1. Participants are aware and agree that there is no guarantee regarding the ticket prices. Hotmart reserves the right to apply differentiated pricing conditions, even if different from the current lots, to ensure the realization and viability of the Event, as well as to carry out promotional actions, such as, but not limited to, offering discount coupons. Any differentiated pricing conditions are not extendable to any Participant who has already purchased their ticket previously.
5.4. Hotmart clarifies that the prices indicated for each ticket above include the following taxes: ISSQN, which corresponds to 5% of the total, and Pis/Cofins, which corresponds to 9.25%.
5.5. In accordance with the special regime adopted with the municipality of Belo Horizonte, Hotmart will issue a fiscal receipt that has the same fiscal validity as an invoice. After the ticket purchase is completed, the receipt will be automatically generated and sent to the email registered by the Participant. For a duplicate request, the Participant must send an email to fire@hotmart.com.
5.6. The Participant declares that they are aware and agree that the Event, being focused on entrepreneurship and the digital commerce audience, does not fall under the category of artistic-cultural and sporting events covered by the Half-Price Law (Law nº 12.933 and Decree nº 8.537/2015), and, therefore, there will be no half-price tickets available for this Event.
5.6.1. There will be no charge for tickets for Participants who are under 12 (twelve) years old at the time of the Event. Such Participants will not receive extras beyond entry to the Event, such as, but not limited to, additional materials, among others. For such Participants, the rule in item 3.2. of these Terms applies, namely, the obligation to be accompanied by parents and/or legal guardians throughout the Event.
5.7. The ticket purchased for the Event will be valid for the entry of only 1 (one) person. Entry will not be permitted for Participants without the identification wristband and badge corresponding to the ticket category purchased for the Event.
5.7.1. A duplicate identification wristband and badge will not be issued in case of forgetfulness or loss. Replacement will only be allowed in cases of theft or robbery, upon presentation of the corresponding police report.
5.7.2. In case of any misuse, attempted duplication, or copying of the ticket, only the holder of the ticket validated first will have access to the Event
venue, even if they are not the ticket's owner.
5.8. The request for a refund may be made by the Participant within the regret period provided by the Consumer Protection Code, that is, within 7 (seven) days from the date of purchase. For tickets purchased within less than 7 (seven) days from the Event date, the maximum period for requesting a refund will be up to 48 (forty-eight) hours before the start of the Event.
5.9. The Participant acknowledges and agrees that the tickets are personal and can only be transferred under the terms of item 5.10 below. In the case of group ticket purchases, the Participant must contact fire@hotmart.com and make this request, which will be evaluated and granted on a case-by-case basis.
5.10. The Participant may transfer the ownership of their ticket, provided that they contact Hotmart support by sending an email to fire@hotmart.com with their registration data and the data of the person to whom the ticket should be transferred. The transfer request can only be made up to 48 hours before the start of the Event, the minimum time necessary for Hotmart to make all necessary changes.
SIXTH CLAUSE - PROMOTIONAL ACTIONS, KITS, AND GIFTS:
6.1. Hotmart may, at its sole discretion and as a mere courtesy, by itself or through third parties, grant, at any time, gifts, kits, and/or carry out occasional promotional actions before and during the Event, which, if granted and/or carried out, may or may not be previously informed and disclosed by Hotmart, at its sole discretion.
6.1.1. The Participant acknowledges and agrees that the granting of gifts and/or kits and/or participation in occasional promotional actions, if any, may be limited to a certain number of participants and/or exclusive to one or more ticket types, at Hotmart's sole discretion.
6.1.2. The Participant also agrees that any kit granted by Hotmart in conjunction with the purchased ticket will only be delivered if the Participant attends the Event. Therefore, there will be no delivery of such kits, if any, to the Participant's home.
6.2. Hotmart may also offer Participants, before, during, or after the Event, occasional actions and/or exclusive experiences, in addition to those provided due to the purchase of Event participation tickets, at its sole discretion, with or without the participation of the Speakers, free of charge or upon payment of an additional fee.
6.2.1. The purchase of any ticket for these occasional actions and/or experiences does not exempt the Participant from the need to purchase the Event ticket, which is indispensable to guarantee entry to the Event.
SEVENTH CLAUSE - INTELLECTUAL PROPERTY AND IMAGE RIGHTS:
7.1. By purchasing a ticket for the Event and in the best legal form, the Participant agrees to assign and transfer to Hotmart, exclusively, in full and on a universal and gratuitous basis, in a total, definitive, irrevocable, and irreversible manner, for the purpose of use at any time, in Brazil and/or abroad, the rights to use their image and voice ("Image and Voice Assignment"), captured during the entirety of the Event, through traditional photo and video cameras, drones, or any other means of capture existing or to be created at the time of the Event, in any format in which they are found, such as, but not limited to, photos, videos, testimonials, and documents, for the production and realization, by Hotmart, in any known or future format, for commercial or non-commercial purposes: (i) of new works; (ii) of promotional campaigns and/or advertisements; (iii) in institutional actions and campaigns; and (iv) any other purposes, for internal or public dissemination, on social media, on Hotmart's websites, and/or on any other physical and/or digital medium available.
7.1.1. Hotmart may process personal data to achieve the purpose set forth in clause 7.1. In this case, the terms of the Eighth Clause must be observed.
7.2. Considering that during the Event, Hotmart, invited speakers, and third parties will present content protected by intellectual property rights, the recording of audio, images, and filming of the lectures and the Event itself will not be permitted, nor will conducting interviews and collecting testimonials from other Event participants, except with prior written authorization from Hotmart.
EIGHTH CLAUSE - PERSONAL DATA PROTECTION:
8.1. Hotmart may process personal data to enable participation in the Event. In this case, personal data will be processed by Hotmart in compliance with applicable personal data protection regulations, observing all terms of the Privacy Policy.
NINTH CLAUSE - GENERAL PROVISIONS:
9.1. The Participant agrees to fully comply with all rules, regulations, and internal regulations issued by the establishment where the Event will be held and/or the platform where the Event will be made available, as well as to respect applicable federal, state, and municipal legislation, under penalty of not being able to participate/being removed from the Event, in any of its modalities.
9.2. The possession, use, and consumption of illicit substances, the possession and use of bladed weapons or firearms, as well as the use of drones and similar devices during the Event will not be permitted. It is also prohibited to enter the Event with food and/or beverages, except water and food intended for diets for people with specific dietary needs.
9.3. Hotmart will provide appropriate treatment to all Participants of the Event. Likewise, the Participant must treat all Participants, speakers, employees, and/or workers present at the Event, whether outsourced or not, with civility and courtesy, under penalty of being removed from the Event.
9.4. Despite the deep respect for all political and religious positions, Hotmart's policy is not to have its institutional image linked to political parties and/or agents, nor to beliefs and religions. In this context, political and religious manifestations will not be tolerated at the Event. If any act, action, conduct, or behavior mentioned above is identified, the Participant agrees to their immediate removal from the Event.
9.5. The Participant acknowledges and agrees that they will not be allowed to conduct, during the Event, activities related to the offer, acquisition, announcement, and/or distribution of third-party products and/or services, without prior authorization from Hotmart, under penalty of being immediately removed from the Event.
9.6. Acts of vandalism, racist, homophobic, and/or prejudiced and discriminatory conduct in general, as well as aggressive or inappropriate behavior that may compromise Hotmart's image, property, and/or business, are considered unacceptable. In addition, any damage to people and/or objects in the stand areas and/or to sponsors may result in measures to protect Hotmart from any liability. If any act, action, conduct, or behavior mentioned above is identified, the Participant may suffer consequences, including removal from the Event.
9.7. The Participant releases Hotmart from any civil or criminal liability for any damages, physical, material, and/or moral harm that may occur during the Event. Additionally, the Participant acknowledges and agrees that Hotmart will not be held responsible, under any circumstances, for damages and losses caused by the action and/or omission, whether negligent or intentional, of third parties, even if contracted by Hotmart in connection with the Event.
9.8. Hotmart may cancel or suspend the Event, including but not limited to for reasons of public safety, public health, public acts, vandalism, and/or force majeure and fortuitous events, without such measure generating the right to a refund of the amounts spent on the ticket purchase and/or reimbursement for related expenses.
9.9. Hotmart also reserves the right, at any time, with prior notice, to modify any items of these Terms and/or the Event. If Hotmart modifies any items of these Terms, Hotmart will not incur any liability as a result of such actions.
9.10. Participants who violate the Terms may be removed from the Event by Hotmart employees, security agents, or by calling the police, without prejudice, in any case, to the adoption of other applicable administrative and judicial measures. Therefore, if the Participant violates the Terms in any way, they will not be entitled to any type of refund, reimbursement, and/or compensation from Hotmart.
9.11. Hotmart is not responsible, at any time, for items forgotten at the venue during the Event. However, during the Event, there will be 1 (one) lost and found collection point for items to be retrieved by their owners. After the Event ends, personal documents and other lost and unclaimed items may be retrieved at Hotmart's headquarters, located at Avenida Assis Chateaubriand, nº 499, Bairro Floresta, CEP nº 30.150-101, until September 29, 2025. After this period, unclaimed identification documents will be sent to the Central Post Office - at Avenida Afonso Pena, 1270, Centro - and may be retrieved at the location within 60 (sixty) days from the date of receipt by the agency. Remaining items will be donated. In case of doubts, contact invitefire@hotmart.com on the subject until September 29, 2025.
9.12. The Event and any disputes arising from its execution and/or these Terms, including but not limited to its promotion, conduct, participation, and, if applicable, prize(s), are governed by Brazilian law.
9.13. The parties also agree that any disputes regarding this instrument and/or the Event that are not resolved amicably will be submitted to the Central Court of the District of Belo Horizonte, MG, hereby elected as the sole competent jurisdiction to resolve them, with express waiver of any other, no matter how privileged it may be or become.
9.14. Any questions or suggestions regarding the Event may be sent to fire@hotmart.com and will be considered by Hotmart when possible.
